Terms of Service

Welcome to Tendr. These Terms of Service ("Terms") are a legal agreement between you and Blue Line Advisory LLC ("we," "us," "Tendr"), the operator of the Tendr app and website.

By signing up for early access, using our website, or downloading and using the Tendr app, you agree to these Terms. If you don't agree, please don't use Tendr. We've tried to write these in plain English. Where we use legal language, it's because it actually matters.

1. Who can use Tendr

You may use Tendr if you are at least 13 years old. If you are under 18, you may use Tendr only with the consent of a parent or legal guardian.

Tendr is built for adults running households. Adults can include children as members of their household for coordination purposes; children do not have their own accounts.

You may use Tendr only in compliance with these Terms and all applicable laws.

2. Your account

To use the Tendr app, you'll sign in with Sign in with Apple. You're responsible for keeping your Apple ID secure. We're not responsible for any unauthorized access that results from someone else getting access to your device or Apple ID.

You may only have one personal account unless we expressly permit otherwise. Don't share your account with others — instead, invite them to your household through the in-app sharing feature.

You can delete your account at any time inside the app (Settings → Account → Delete Account) or by emailing nrolls@comcast.net.

3. The early-access waitlist

If you join our pre-launch waitlist, you agree that:

You can unsubscribe at any time. Unsubscribing from marketing emails does not affect the lifetime Tendr+ offer if you've already qualified.

4. Subscriptions and payments

Tendr offers a free tier and a paid subscription called Tendr+.

Pricing: Tendr+ is offered at the prices shown in the App Store at the time of purchase. As of this writing, the expected prices are $4.99/month or $39.99/year, but actual pricing may vary by region and is set in the App Store.

Free trial: A free trial may be offered. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation: You can cancel anytime through your Apple ID settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period. We don't offer prorated refunds for partial periods.

Refunds: All payments are processed by Apple. Refund requests must be submitted through Apple at reportaproblem.apple.com. We cannot process refunds directly.

Price changes: If we change subscription prices, the new price will not apply to your current subscription until your next renewal. You'll be notified before any price increase takes effect, and you can cancel if you don't want to continue.

5. What you can do with Tendr

You may use Tendr for your personal household management. You may not:

6. AI assistant — important disclaimers

The Tendr AI assistant uses large language models (currently Anthropic's Claude) to help you manage your household. The assistant can make mistakes.

Specifically:

You are responsible for reviewing what the AI does. Tendr is designed to show you exactly what the assistant did with one-tap undo, but you should still verify important actions — especially those involving appointments, medications, allergies, school deadlines, or money.

Do not use the AI assistant for anything where an error would cause serious harm. Tendr is a household coordination tool, not a safety-critical system.

7. Third-party integrations

Tendr connects to your Apple Calendar, Apple Reminders, and (when you choose) to third-party apps like Instacart, Amazon, and Walmart. These integrations are governed by:

When you tap "Send to Instacart" (or similar), you are leaving Tendr and entering that third-party app. We are not responsible for what happens inside those apps, including but not limited to: order accuracy, delivery, customer service, refunds, returns, payment processing, or product quality. Disputes about orders must be resolved with the third party, not with us.

9. Intellectual property

Our stuff is our stuff. The Tendr name, logo, app, website, designs, code, and all related materials are owned by Blue Line Advisory LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use Tendr for its intended purpose.

Your stuff is your stuff. Your household data — events, tasks, list items, meals, AI conversations — belongs to you. By using Tendr, you grant us the limited rights necessary to operate the service (e.g., processing your AI requests to return responses). We don't claim ownership of your data.

Feedback. If you send us suggestions, bug reports, or other feedback, we may use it freely to improve Tendr without owing you anything in return.

10. Disclaimers

We provide Tendr "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We don't guarantee that:

Some jurisdictions don't allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, Blue Line Advisory LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of Tendr, even if we've been advised of the possibility of such damages.

Our total liability to you for any claim related to Tendr is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100 USD.

This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory.

Some jurisdictions don't allow these limitations, so parts of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Blue Line Advisory LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of:

You may stop using Tendr and delete your account at any time.

We may suspend or terminate your access to Tendr if:

Upon termination, Sections 8 (Data), 9 (IP), 10 (Disclaimers), 11 (Liability), 12 (Indemnification), and 14 (Dispute Resolution) survive.

14. Dispute resolution and governing law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict of laws rules.

Informal resolution first. Before filing any formal claim, you agree to contact us at nrolls@comcast.net and try to resolve the dispute informally. We'll do the same. Most disputes can be resolved this way within 30 days.

Arbitration. If informal resolution doesn't work, any dispute arising out of or related to these Terms or Tendr will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in New York County, New York, or via remote proceedings if both parties prefer.

You and we both waive the right to a jury trial and the right to participate in a class action.

Exceptions. Either party may bring a claim in small claims court (where eligible) or seek injunctive relief in court for misuse of intellectual property.

If for any reason a court finds the arbitration clause unenforceable, any litigation will take place exclusively in the state or federal courts located in New York County, New York.

One-year limitation. Any claim arising out of these Terms or Tendr must be brought within one year of when it arose, or it is permanently barred.

15. Changes to these Terms

We may update these Terms from time to time. When we do:

If you don't accept changes, your only remedy is to stop using Tendr.

16. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and any in-app purchase terms shown at the time of subscription, are the entire agreement between you and Blue Line Advisory LLC regarding Tendr.

Severability. If any part of these Terms is found unenforceable, the rest still applies.

No waiver. If we don't enforce a provision of these Terms, that doesn't mean we've waived our right to enforce it later.

Assignment. You may not transfer or assign these Terms. We may transfer or assign them to a successor entity (e.g., in a merger or sale) without your specific consent.

Notices. We may give you notices by email, through the app, or by posting on our website. You may give us notice at nrolls@comcast.net.
